Football agents received a courtroom setback in their hopes of biting back at rules set down by the English Football Association designed to clamp down on clubs paying agents.
A Leeds court ruled for Gillingham keeper Kelvin Jack in a case filed against him by agent Mike Berry. Jack refused to pay and agent fee when he found out Berry received a secret GBP 3,000 payment from Dundee.
"The payment was a secret commission in the sense simply of a payment which was not disclosed to the principal and that the agent thereby put himself in a position where his own interests and his duty to the defendant conflicted, or at least may have conflicted," read a judge's statement.
Mr. Recorder Walker then ordered Berry to pay the keeper the majority of the GBP 3,000, plus legal costs. Berry was allowed to retain some agent fees, though this will be appealed by Jack.
